Selection--Absence of Waiting List Provision in Recruitment Rules Bars Next Candidate From Claiming Vacancy Left by Non-Joining by Selected Candidate
A select list confers eligibility for consideration within the statutory framework; it does not create a vested right to appointment. Where recruitment rules do not provide for a waiting list or for filling vacancies arising from non-completion of pre-appointment formalities, such vacancy must be treated as fresh and filled through a new recruitment process. Migration to a higher post by operation of the same select list is impermissible absent express statutory sanction.
