Denial of salary for services rendered amounts to a violation of Article 21 and Article 23 of the Constitution. The right to livelihood is an integral component of the right to life under Article 21, and withholding wages for work duly performed constitutes forced labour prohibited under Article 23. No employer, including a State authority, can extract work without payment. Fundamental rights cannot be waived, and delay or non-completion of formalities cannot operate as waiver of an employee's entitlement to salary. Placement of an employee in a cooperative store by way of deputation does not sever the employer-employee relationship with the parent federation.
