Right to Travel Abroad--Accused in Abetment of Suicide Case--Article 21 Balanced Against Right to Speedy Trial Restricts Foreign Travel

The right to travel abroad under Article 21 of the Constitution is not absolute and must be balanced against the right of the complainant to a speedy trial and the larger societal interest in effective administration of criminal justice. An accused who repeatedly files petitions, obtains interim protection, withdraws them before final adjudication, and leaves the country on a suspended Look Out Circular without leave of the Court cannot claim that restrictions on foreign travel violate fundamental rights. Permission for foreign medical treatment should not be granted indulgently where comparable medical facilities are available in India.
