NDPS--Financing Illicit Traffic--Mere Receipt of Money Without Evidence of Channelisation Does Not Attract Section 27A
"Financing illicit traffic" under Section 27A of the NDPS Act, 1985 is distinct from mere receipt of money arising from a narcotics transaction. Financing ordinarily means provision, investment or channelisation of funds for facilitating illicit trafficking activities, and mere receipt of money, without material showing its use for such financing, may not by itself satisfy Section 27A. Cancellation of bail is different from rejection of bail and requires cogent circumstances arising after the grant of bail, such as misuse of liberty, tampering with evidence, or absconding, and not a mere re-appreciation of material already considered.
