Pleadings -- Unauthorized Replacement of Plaint Pages -- Amounts to tampering with court record and served copies

(i) Bombay High Court Original Side Rules, R.42(7) -- Pleadings -- Unauthorized Replacement of Plaint Pages -- Correction of a pleading requires a written application, permission of the designated officer, and counter-signed endorsements, with corrected copies served on the opposing side. Retyping and substituting a page without following this procedure, whether in the court record or in copies served on defendants, amounts to tampering with the pleadings. (ii) Notaries Act, 1952, S.8 -- Notary Public -- Affixing Seal on Substituted Page After Oath -- Once a document is notarised on solemn affirmation, the Notary is not permitted to replace any page or affix a seal on a substituted page. Such conduct amounts to tampering with the original notarised document and is a breach of the statutory duty of verification.
