Judgment on Admission -- Form and Source of Admission -- No particular form required, may be written or oral

(i) Civil Procedure Code, 1908, O.12 R.6 -- Judgment on Admission -- Form and Source of Admission -- A decree can be passed under this provision on the basis of an admission, whether contained in pleadings or elsewhere. Such admission may be in writing or oral, and no particular form of admission is necessary. (ii) Civil Procedure Code, 1908, O.12 R.6 -- Judgment on Admission -- Nature of Admission Required -- The admission on which judgment is claimed must be clear and unequivocal. It may relate either to the entire claim made in the suit or to a part of the claim for which a decree can be passed separately. (iii) Civil Procedure Code, 1908, O.12 R.6 -- Judgment on Admission -- Power of Court to Act Suo Motu -- The Court, on its own motion and without an application by any party, can proceed to pass a decree on an admission.
