Hindu Undivided Family -- Widow as Karta -- Cannot act as Karta of deceased husband's HUF
(i) Hindu Law -- Hindu Undivided Family -- Widow as Karta -- A Hindu widow is not a coparcener in her husband's Hindu Undivided Family and therefore cannot act as Karta of the family after his death. (ii) Registration Act, 1908, S.34 -- Registration of Document -- Absence of Title in Executant -- Where an executant executes a sale deed or lease deed in respect of land in which he has no title, the registering officer cannot refuse registration if procedural compliances are made and requisite stamp duty and registration charges are paid. However, where the executant has no right, title, or interest in the property, the registered document cannot effect any transfer.
