Pension -- Conviction for Dishnour of Cheque -- Not a Ground to Withhold Pension
Conviction under Section 138 of the Negotiable Instruments Act does not constitute a "serious crime" or "grave misconduct" within the meaning of Rule 8(b) of the Tamil Nadu Pension Rules, 1978. An offence under Section 138 is essentially a civil wrong given criminal overtones and does not involve moral turpitude. Pension of a retiree cannot be withheld or stopped on the basis of such conviction, as Rule 8(b) applies only to convictions involving serious crimes amounting to grave misconduct.
