Loss of domestic care provided by a homemaker is a distinct and compensable head of damages in motor accident claims. It is submitted that homemakers make an enormous contribution to the household and to society at large – describing them as dependants of earning members is a mischaracterisation when the household's functioning depends substantially on their labour. Courts are required to assign a pecuniary value to this contribution. The Supreme Court has now fixed a minimum of ₹30,000 per month under the head of "loss of domestic care," to be revised by 10% cumulatively every three years. Where the homemaker was also part of the workforce, this amount is payable in addition to proved monthly income.
