Divorce by Mutual Consent -- Petition Within One Year of Marriage -- Waiver of Statutory Period -- Unconsummated Marriage
Where parties lived together for only about seven days after marriage and thereafter separated, the statutory period of one year prescribed under S.14 of the Act is liable to be waived -- Where the marriage remained unconsummated, there are no children born out of the wedlock, and both parties have entered into a mutual settlement and unequivocally expressed their intention not to continue the matrimonial relationship, the case is a fit one for waiver of the statutory period -- Matter remanded to the Family Court to proceed with the petition under S.13-B of the Act--Hindu Marriage Act, 1955, Ss.13-B, 14.
