CPC, 1908, O.12 R.6 -- Judgment on Admission -- Admission Must Be Clear and Unconditional
Judgment on admission is an exception to the ordinary rule that civil disputes must be decided after a full trial with evidence. The provision must therefore be applied with caution. Pleadings cannot be read in a piecemeal manner — they must be read as a whole. An isolated statement in a written statement that does not amount to an unequivocal admission of liability towards the claimant cannot be the basis for a decree under this provision.
