Motor Accident Compensation--Future Attendant Charges--Compensation Assessed Individually on Facts, Not Bound by Precedent

Precedents in motor accident compensation cases have only persuasive value, since each case has to be decided individually based on its own facts and circumstances. The purpose of insurance is to cover the insured in real terms for an unfortunate event that is an incidence of life and cannot be avoided. Future attendant charges must be assessed on a real-time basis, considering the number of attendants required, the rates at which such help can be engaged, and related medical expenses, rather than as a mere formality.
