Arbitration--Application Under Section 33--Limitation for Section 34 Application Runs from Disposal of Section 33 Request
Limitation for filing an application under Section 34 of the Arbitration and Conciliation Act, 1996 is to be reckoned from the date on which a request under Section 33 is disposed of by the Arbitral Tribunal, once such request has been entertained. Section 34(3) does not distinguish between applications under Section 33 that are allowed or dismissed. Parties cannot be compelled to file under Section 34 as a matter of caution while proceedings under Section 33 are pending. The limitation period under Section 34(3) commences only from the date of disposal of the Section 33 proceedings.
