Fair Price Shop--Married Daughter--Dependency Not Marital Status Governs Eligibility Under Dependent Quota Scheme
Marital status cannot be a valid ground for denying welfare benefits to an otherwise eligible daughter. Dependency, not marital status, is the governing criterion for allotment of a fair price shop under the dependent quota. The expression "daughter" must be read to include a married daughter, provided she establishes dependency on the deceased dealer and satisfies local residence and other eligibility conditions. Exclusion of married daughters based on the assumption that marriage severs ties with the natal family rests on gender stereotypes and violates Articles 14 and 15(1) of the Constitution.
