Family Pension--Deceased Employee's Brother--Brother Does Not Fall Within the Definition of Family Under Clause 5(s)(2) of Pension Scheme, 1981 and Cannot Claim Family Pension

A brother of a deceased employee does not fall within the definition of "family" for the purpose of family pension under Clause 5(s)(2) of the Pension Scheme, 1981. Entitlement to family pension is strictly governed by the definition of family under the applicable scheme, and a succession certificate alone does not expand that definition or confer pension rights on otherwise ineligible claimants. Interest on delayed pension disbursement is not automatic and courts must exercise restraint before imposing such financial burden on the State.
