Family Pension--Customary Divorce of Daughter--Sufficient to Establish Dependent Status -- Entitled to Family Pension Under Railway Pension Rules
A daughter of a railway employee who has obtained a customary divorce is a dependent under the applicable pension rules and is entitled to family pension. The absence of the daughter's name in forms filled by the pensioner during his lifetime does not defeat her claim, where her status as a divorced daughter is otherwise established through inquiry proceedings. A customary divorce, even without a formal court decree, is sufficient to establish the marital status of the claimant for the purpose of family pension eligibility.
