Departmental Inquiry -- Authenticity of Documents in Disciplinary Proceedings Must Be Established Through Competent Witnesses Having Knowledge
Findings in a departmental inquiry cannot be based solely on documents collected during investigation unless their contents are proved through competent witnesses having knowledge thereof and capable of deposing to their authenticity. No document may be relied upon by the prosecution without supplying a copy to the delinquent employee. The Enquiry Officer has a duty to arrive at findings upon materials duly brought on record by the parties. A disciplinary decision must rest on legally admissible evidence; investigation records do not by themselves constitute evidence in disciplinary proceedings.
