Bharatiya Nagarik Suraksha Sanhita, 2023, S.483 -- Bail -- Settlement by Mother in Sexual Assault of Minor Daughter -- Compromise effected by mother of minor victim with father accused of sexual assault does not bind the minor and cannot be treated as a ground for bail. Offences of sexual assault of a minor are not compoundable, and parents cannot settle, withdraw, or express no objection to prosecution or bail in such cases. Courts exercise parens patriae jurisdiction to protect interest of the minor victim even where parents fail to do so.
