Advocate as Co-Accused -- BCI Rules -- Representing Co-Accused Not Prohibited, No Fraud Upon Court Made Out
Rule 13 of the Bar Council of India Rules, falling under the category of duty to clients, only restrains an advocate from accepting a brief where he has reason to believe he may be called as a witness on material questions of fact. It does not prohibit a co-accused advocate from appearing as counsel for another accused in the same matter. Appearance by a co-accused advocate on behalf of another accused does not, by itself, constitute fraud upon the court.
