Wills--Exclusion of Natural Heirs--Exclusion Alone Without Accompanying Suspicious Circumstances Does Not Invalidate Will Under Indian Succession Act
Exclusion of natural heirs from a Will does not, by itself, constitute a suspicious circumstance invalidating the Will. The purpose of a Will is precisely to alter the normal line of succession, and a testator is legally entitled to dispose of property according to personal wishes. Suspicion arises only when exclusion is accompanied by circumstances affecting the genuineness or due execution of the Will. Further, non-registration of a Will raises no adverse inference against its genuineness, as registration is not a legal requirement.
