Temple Funds--Temple Donation Box Collections Held in Trust for Community of Worshippers; Poojaris Cannot Claim Share as Matter of Right
Hundi collections of a temple are resources held in trust for the community of worshippers and carry a public character. Poojaris are not entitled to claim a share in such collections as a matter of right, as settled in Shri Jagannath Temple Puri Management Committee v. Chintamani Khuntia, (1997) 8 SCC 422. Payment made to poojaris for livelihood does not confer hereditary entitlement over hundi collections. Hereditary poosariship under Section 55 of the Tamil Nadu Hindu Religious and Charitable Endowments Act requires substantiation by material evidence and proof of governing Agama mandating hereditary priesthood.
