Suit for Ownership--Historical Records Cannot Substitute Revenue Entries To Prove Property Title Under S.57 Evidence Act

Section 57 of the Evidence Act permits courts to use books or documents of reference only for matters of public history, literature, science, or art. Title to property is a matter of private or local nature. Historical works cannot establish title to property, even if authored by reputed historians. Revenue records showing ownership in the name of a ziarat carry strong evidentiary value, and the presumption attached to such entries must be rebutted by cogent material.
