Succession Certificate -- Security -- Surety -- Indemnity Bond -- Not to be Mechanically Insisted Upon
The condition of furnishing security, surety, or indemnity bond under Section 375 of the Indian Succession Act, 1925 cannot be mechanically insisted upon in all cases. Where the applicant is the sole beneficiary of the deceased's estate, or is a natural heir of the deceased, and no objections have been raised by any other claimant, the court may, in appropriate cases, exempt the applicant from the requirement of furnishing such security, surety, or indemnity bond -- Indian Succession Act, 1925 -- Section 375.
