Specific Performance -- Delay in Legal Notice -- Not evidence of lack of readiness and willingness when overall conduct establishes performance

Specific Relief Act, 1963, S.16(c) -- Specific Performance -- Delay in Legal Notice -- Readiness and willingness to perform a contract must be assessed from the overall conduct of the plaintiff and the attending circumstances of the case. Delay in issuing a legal notice is not, by itself, evidence of lack of readiness and willingness — particularly where the plaintiff has paid 93% of the sale consideration and filed the suit within the period of limitation.
