Guardianship of Minor -- Development Agreement over Minor's Property -- Evident advantage must be assessed realistically, not on technical or speculative grounds
Hindu Minority and Guardianship Act, 1956, S.8 -- Guardianship of Minor -- Development Agreement over Minor's Property -- A court examining a natural guardian's application for permission to alienate a minor's immovable property must undertake a realistic assessment of whether the proposed transaction offers evident advantage to the minor. An undeveloped undivided interest in land may offer limited practical utility; a completed residential unit and liquid funds can constitute evident advantage satisfying the requirement under Section 8(4).
