Sexual Intercourse by Deceitful Means -- Complainant a Married Woman with Subsisting Marriage -- Promise of marriage cannot be sole ground where complainant's own marriage subsists
(i) Bharatiya Nyaya Sanhita, 2023, S.69 -- Sexual Intercourse by Deceitful Means -- Complainant a Married Woman with Subsisting Marriage -- A married woman who voluntarily accompanies another man to a hotel room and has sexual intercourse with him cannot, merely on an allegation of promise of marriage, contend that the relationship was induced solely by such promise, particularly where her own subsisting marriage is not in dispute. The essential ingredients of deceitful inducement under Section 69 BNS are not made out in such circumstances. (ii) Bharatiya Nagarik Suraksha Sanhita, 2023, S.528 -- Quashing of Proceedings -- Settlement Between Parties Where Societal Interest Involved -- Criminal proceedings involving an element of societal interest cannot be quashed solely on the ground of settlement between the parties. Quashing is nonetheless warranted where the material on record does not disclose commission of the alleged offence and continuation of proceedings would serve no useful purpose.
