(i) Bharatiya Nyaya Sanhita, 2023, S.69 -- Sexual Intercourse by Deceitful Means -- Accused Proposed Marriage to Complainant's Mother -- Absence of intention to marry cannot be attributed to an accused at the stage of bail where he subsequently approached the complainant's mother with a proposal of marriage, even if the proposal was refused. Section 69 BNS requires sexual intercourse induced by deceitful means or by a promise to marry made without any intention of fulfilling it. (ii) Bharatiya Nagarik Suraksha Sanhita, 2023, S.483 -- Bail -- Custody Period and Progress of Investigation -- Period already spent in custody and substantial completion of investigation are relevant factors favouring grant of regular bail.
