Recall of Witness -- Scope and Purpose
O.18 R.17 CPC does not give either party the right to further examine or cross-examine a witness who has already been examined -- This provision empowers only the Court to put questions to such a witness -- The key consideration is whether the trial Court is satisfied that recalling the witness is necessary to clarify certain aspects of the matter -- This provision cannot be used by either party as a tool to gain advantage over the other -- CPC, 1908, O.18 R.17 (Para 4)
