Obscenity -- Abusive or Vulgar Language -- Distinct from obscenity and does not attract Section 294 IPC
(i) Indian Penal Code, 1860, S.294(b) -- Obscenity -- Abusive or Vulgar Language -- Obscenity is not synonymous with vulgarity, abuse or profanity. Swear words and vulgar expletives, however distasteful, do not amount to obscenity unless the words are lascivious, appeal to prurient interest and tend to deprave and corrupt susceptible minds. Absence of proof that the utterance caused annoyance to others in a public place also defeats the offence. (ii) Indian Penal Code, 1860, S.506(ii) -- Criminal Intimidation -- Threatening Words During Altercation -- Mere utterance of threatening words during a quarrel does not establish criminal intimidation. Evidence must show that the words were intended to cause alarm to the person threatened or to compel him to do or omit to do an act which he was not legally bound to do.
