Cruelty -- Pressure to Sign Divorce and Custody Papers -- Does not amount to cruelty under BNS
(i) Bharatiya Nyaya Sanhita, 2023, S.85, 86 -- Cruelty -- Pressure to Sign Divorce and Custody Papers -- Pressure to accept terms of separation during matrimonial negotiations is not cruelty. It is neither a demand for property or valuable security nor, absent repeated conduct, wilful conduct likely to drive a woman to suicide or cause grave injury. A solitary episode of pressuring a spouse to sign divorce and custody papers does not satisfy either limb of Section 86. (ii) Bharatiya Nyaya Sanhita, 2023, S.126(2) -- Wrongful Confinement -- Inconsistent Versions of Complainant -- Where the earliest narration of the complainant states that she locked herself inside a room out of fear, a later and inconsistent version alleging captivity and escape cannot be reconciled with it. The earliest version itself negatives the ingredient of confinement.
