Mutation--Pendency of Municipal Dues Is No Bar to Sanction of Mutation In Absence of Statutory Authority
Mutation of property cannot be withheld on the ground of pending municipal dues unless a statutory provision expressly permits such a condition. An administrative order of the Municipal Commissioner imposing dues-clearance as a precondition for mutation has no statutory backing and is without authority. Where no rule or regulation under the Act supports such an embargo, the condition cannot be enforced.
