Mutation -- On Basis of Will -- Proof of Will -- Challenge to Mutation Entry
Where a mutation is sought to be entered on the basis of a Will, the plea that the Will must first be proved before mutation is entered cannot be sustained, particularly when the party raising such objection had full knowledge of the Will yet chose not to challenge it. It is well settled that a mutation entry does not confer or reflect ownership rights -- it merely records certain facts relating to the land in question for revenue purposes. In such circumstances, the Single Judge was justified in refusing to interfere with the mutation entry.
