Muslim Law--Talaq--Court Decree Confirming Talaq Relates Back To Date Of Pronouncement, Creates No Fresh Divorce

Under Mohammedan Law, talaq takes effect from the date of its pronouncement by the husband. A subsequent court decree confirming the talaq is merely declaratory in nature and relates back to the original date of pronouncement. It does not create a fresh divorce from the date of the judgment. Where validity of talaq is disputed, the trial court must examine evidence to determine whether talaq was validly pronounced in accordance with law.
