Motor Accident --Institutional Dependency Recognised-- Religious Mutt Qualifies as Legal Representative for Loss of Dependency Claim For Death Of Head Priest

A religious mutt qualifies as a "legal representative" under Section 2(11) of the Civil Procedure Code for the purpose of claiming motor accident compensation. The term "legal representative" must receive purposive interpretation, not a restrictive one. The concept of dependency in motor accident claims is not confined to familial ties and extends to institutional dependency. Death of a mathadipathi causes tangible institutional loss, including disruption of spiritual leadership, administrative continuity, and institutional income. Such loss entitles the mutt to compensation under the head of loss of dependency.
