Motor Accident Compensation--Income--Engineering Student--Notional Income Assessed As Rs.30,000/- per month
Assessment of notional income of a young engineering student at a manifestly inadequate figure, ignoring academic credentials and future earning potential, is contrary to the principle of "just compensation" under the Motor Vehicles Act. Courts must take a realistic and evidence-based approach while fixing notional income, having regard to the institutional standing, academic record, and career trajectory of the deceased. Compensation must also account for future prospects and conventional heads as mandated by National Insurance Co. v. Pranay Sethi and Sarla Verma v. DTC.
