Motor Accident Compensation -- Death of Chartered Accountancy Student -- Compensation cannot be based on assumed professional success or unrelated salary benchmarks

(i) Motor Vehicles Act, 1988, S.166 -- Motor Accident Compensation -- Death of Chartered Accountancy Student -- Just compensation must account for future prospects of the deceased but cannot rest on assumptions of assured professional success or on salary benchmarks of unrelated successful professionals, where there is no cogent material to establish such future income. (ii) Motor Vehicles Act, 1988, S.166 -- Motor Accident Compensation -- Omission of Conventional Heads -- Omission of the conventional head of filial consortium for parents of a deceased child is a legal error, and being a beneficial legislation, the Motor Vehicles Act requires the Court to ensure just compensation is awarded under such heads even at a later stage.
