Motor Accident Claim -- Foreign Driving Licence Without International Permit -- Foreign domestic driving licence without international driving permit or Indian authorisation is not a valid licence to drive in India
(i) Motor Vehicles Act, 1988, S.3 -- Motor Accident Claim -- Foreign Driving Licence Without International Permit -- A driving licence issued by a foreign authority is not valid to drive a vehicle in India merely because it is valid in the country of issuance. It must be accompanied by an international driving permit recognised in India or an endorsement by a competent Indian authority. Absent such authorisation, the holder is not treated as possessing a valid and effective driving licence under Section 3 of the Act. (ii) Motor Vehicles Act, 1988, S.149 -- Insurance -- Vehicle Driven Without Valid Licence -- Where the driver of the offending vehicle did not possess a valid and effective driving licence, the insurer is entitled to avoid its contractual liability to indemnify the insured. The insurer remains statutorily liable to satisfy the award in favour of third-party claimants and can thereafter recover the amount from the driver and owner.
