Motor Accident Claim -- Death of Homemaker -- Loss of Domestic Care -- Minimum of Rs.30,000 per month fixed as compensable head of damages

Motor Vehicles Act, 1988, S.166 -- Motor Accident Claim -- Death of Homemaker -- Loss of Domestic Care -- Loss of domestic care provided by a homemaker is a distinct and compensable head of damages in motor accident claims. Courts are required to assign a pecuniary value to this contribution. The Supreme Court has fixed a minimum of Rs.30,000 per month under the head of loss of domestic care, to be revised upward by 10% cumulatively every three years. Where the homemaker was also part of the workforce, this amount is payable in addition to proved monthly income.
