Matrimonial Proceedings--Reconciliation Stage--Video Conferencing Not Permissible Until Reconciliation Fails and Parties Consent

Video conferencing is not permissible at the stage of reconciliation in matrimonial proceedings. The Rules for Video Conferencing for Courts, 2023, being procedural in nature, cannot override binding precedent or statutory provisions. As settled in Santhini v. Vijaya Venkatesh (2018), virtual participation may be permitted only after reconciliation fails and upon consent of both parties through a joint application. The object of reconciliation proceedings is personal interaction in a confidential atmosphere, which virtual mode cannot effectively serve. Section 11 of the Family Courts Act, 1984 mandating in-camera proceedings must be strictly followed.
