Maintenance and Welfare of Parents and Senior Citizens Act, 2007, S.5 -- Maintenance under Senior Citizens Act -- Senior Citizen Receiving Regular and Family Pension -- Not entitled to maintenance application -- Only a senior citizen who is unable to maintain himself from his own earnings or out of property owned by him is entitled to apply for maintenance under Section 5. A senior citizen who regularly receives a pension as well as the family pension of a deceased spouse does not fall within the class of persons unable to maintain themselves and cannot invoke the provision.
