(i) Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, S.9 -- Sexual Harassment at Workplace -- Complaint Beyond Limitation Period -- Barred where no incident within three months prior to lodging -- A complaint of sexual harassment must be lodged within three months of the last incident. Where the complaint discloses no incident of sexual harassment within three months preceding its lodging, the complaint is barred by limitation under the Act. (ii) Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, S.2(n) -- Sexual Harassment at Workplace -- Apprehension of Future Harassment -- Does not constitute sexual harassment under the Act -- The Act does not contemplate mere apprehension in the mind of a complainant regarding possible future sexual harassment as constituting an act of sexual harassment for the purpose of a complaint under the Act.
