Maintenance to Wife--Husband's Obligation Under Section 125 Cr.P.C. to Maintain Ex-Wife Not Discharged Merely Because She Is Educated or Has Parental Support; Maintenance Must Reflect Marital Standard of Living

Statutory obligation of maintenance under Section 125 of the Code of Criminal Procedure is not discharged merely because the ex-wife is educated or has parental support. Maintenance must be determined considering the standard of living during marriage, status of parties, capacity of the husband to pay, and impact of inflation. Education or self-sufficiency of the wife is not a valid ground to deny or reduce maintenance.
