Maintenance to Parent -- Claim Against Daughter-in-Law -- Daughter-in-law not covered under definition of "children"; maintenance claim against granddaughter unreasonable
(i) Maintenance and Welfare of Parents and Senior Citizens Act, 2007, S.2(a) -- Maintenance to Parent -- Claim Against Daughter-in-Law -- A daughter-in-law does not fall within the definition of "children" under Section 2(a) of the Act. A maintenance claim by a senior citizen against a daughter-in-law, or against a student granddaughter financing her studies through an education loan, cannot be sustained under the Act. (ii) Maintenance and Welfare of Parents and Senior Citizens Act, 2007 -- Maintenance to Parent -- Claim to Share in Family Pension -- The Act does not contemplate a claim by a senior citizen for disbursement of a share in the family pension paid to the widow of her deceased son. Such a claim, if any, must be pursued through a remedy outside the Act.
