Maintenance to Child -- Postgraduate Education of Major Unmarried Daughter -- Father liable to bear expenses under DV Act
(i) Protection of Women from Domestic Violence Act, 2005, S.20 -- Maintenance to Child -- Postgraduate Education of Major Unmarried Daughter -- Father is liable to bear educational expenses even after the daughter attains majority, since parental obligation to provide education does not cease on attaining adulthood. A daughter, on attaining majority, falls within the definition of woman and may claim monetary relief as an aggrieved person if domestic violence is established. Section 20(1) empowers the Magistrate to grant monetary relief not confined to enumerated categories, extending to educational expenses for undergraduate or postgraduate studies. (ii) Protection of Women from Domestic Violence Act, 2005, S.3(d)(iv) -- Economic Abuse -- Deprivation of Educational Expenses -- Constitutes economic abuse where a father deprives his daughter of financial resources to which she is entitled by custom, including education. The expression "deprivation of economic or financial resources to which the aggrieved person is entitled under any law or custom" covers denial of educational support, and availability of a bank loan to the daughter is not a ground to deny such relief.
