Maintenance Pendente Lite -- Qualified Wife-- Denial of Maintenance Justified Where Qualified Spouse Voluntarily Refrains from Earning

Maintenance under Section 24 of the Hindu Marriage Act, 1955 can be denied where the applicant spouse, despite possessing professional qualifications and demonstrable earning capacity, voluntarily refrains from employment. The provision is intended to support a spouse who is genuinely unable to maintain themselves, not one who is capable of earning sufficiently but chooses not to do so in order to impose a financial burden upon the other spouse.
