MACT-- Licence -- Non-Conversion of Booklet Form Driving Licence to Smart Card Within Stipulated Period Does Not Render It Fake

A driving licence in booklet form cannot be treated as fake solely on the ground that it was not converted into a smart card, where the prescribed deadline for such conversion had not yet expired at the time of the accident. Under the relevant notification of the Nagaland Transport Authority dated August 1, 2014, the deadline for conversion was December 1, 2014. Repudiation of an insurance claim on such a ground amounts to an unjustified breach of the insurer's obligation. The burden of proving a breach of policy conditions lies on the insurer.
