Lok Adalat Award--Settlement Between Parties--Signature Of Party On Joint Memo Is Mandatory For Validity Of Lok Adalat Award; Signature Of Advocate Alone Insufficient
A Lok Adalat award is binding only when parties themselves sign the joint memo of settlement. Regulation 17 of the National Legal Services Authority (Lok Adalats) Regulations mandates that parties affix their signatures after fully understanding the terms of settlement. Signature of an advocate alone, without the signature of the party, does not make the award binding upon that party. A concession made by counsel cannot bind the client, nor can counsel surrender legal rights of the client — as settled in Kirti v. Oriental Insurance Company Limited (2021) 2 SCC 166.
