Judgment on Admission -- Pleadings to be Read as a Whole -- Isolated statement not amounting to unequivocal admission insufficient for decree
Civil Procedure Code, 1908, O.12 R.6 -- Judgment on Admission -- Judgment on admission is an exception to the ordinary rule that civil disputes must be decided after a full trial. The provision must be applied with caution. Pleadings cannot be read in a piecemeal manner and must be read as a whole. An isolated statement in a written statement that does not amount to an unequivocal admission of liability towards the claimant cannot form the basis for a decree under O.12 R.6.
