Injunction -- Co-owners -- Suit for Permanent or Mandatory Injunction by One Co-owner Against Another
A co-owner cannot file a suit for permanent or mandatory injunction against another co-owner, even if different co-owners are separately holding and possessing distinct portions of the jointly owned property. In such a situation, the only correct and legally available remedy for the plaintiff is to file a suit for partition of the jointly held property through the appropriate legal process. -- Specific Relief Act, 1963, Ss. 38 & 39
