Findings of Fact--Property Title Dispute--Erroneous Observations in Judgment Cannot Be Relied Upon in Subsequent Proceedings
Observations made by a High Court in a civil revision petition that mischaracterise the pleaded positions of parties or the effect of prior judicial directions are prima facie erroneous and cannot be relied upon by parties in ongoing or future litigation to assert claims of title, identity, or location of property. Such observations, made without formal adjudication on the basis of pleadings and evidence, do not constitute findings on title.
